Streamhub ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which may be found on the U.S. Copyright Office website, we will respond expeditiously to claims of copyright infringement committed using the Streamhub service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.
This policy constitutes an integral part of our Terms of Service. By utilizing our platform, you agree to be bound by the procedures outlined herein regarding intellectual property disputes.
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.
Upon receipt of Notice as described below, Streamhub will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site. A formal DMCA Takedown Notice must include the following components:
If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a Counter-Notice containing the following information to our Designated Copyright Agent:
If a Counter-Notice is received by the Copyright Agent, Streamhub may send a copy of the Counter-Notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the Counter-Notice, at our sole discretion.
In accordance with the DMCA and other applicable law, Streamhub has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. Streamhub may also at its sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
All DMCA Takedown Notices and Counter-Notices must be delivered to our Designated Copyright Agent. Please use the contact forms or administrative emails provided on our platform to reach our legal department. Ensure that the subject line clearly indicates "DMCA Notice" to expedite processing.
